Prenuptial or Postnuptial Agreement

A Prenuptial Agreement is intended to disclose and identify the parties’ assets, liabilities, income and expenses and provide for an understanding how such assets and liabilities will be divided or distributed in the event of a divorce and/or death. The prospective parties must be represented by independent legal counsel and the parties need to provide full disclosure of their respective assets, liabilities, income and expenses. As a rule of thumb the Prenuptial Agreement should be fully executed at least thirty (30) days prior to the scheduled wedding date, which means the process should be started well in advance. A Postnuptial Agreement is similar to a Prenuptial Agreement except it is executed by the parties following the marriage.
