Community Property Agreement
A Community Property Agreement contemplates an agreement between spouses and typically provides for establishing the character (i.e. separate property versus community property) of existing assets and liabilities owned by the spouses, and after-acquired assets and upon death of one spouse provides all the assets pass to the surviving spouse via the Community Property Agreement. This type of agreement avoids probate. For a variety of reasons, we do not use the Community Property Agreement very often.
